1. General Information and Acceptance of Terms

This document governs the Terms and Conditions of use (hereinafter “Terms”) of the website of Delicius Rizzoli S.p.A. Benefit Company (hereinafter “Delicius” or “Company”), a company with registered office in Via Micheli, 2 43056 San Polo di Torrile, Parma, registered in the Register of Companies of Parma, VAT no. 00256780347.

The access and use of the website (hereinafter “Site”) by the user (hereinafter “User”) implies full and unconditional acceptance of these Terms. If the User does not accept, even in part, these Terms, he/she must immediately refrain from using the Site.

Delicius reserves the right to change these Terms at any time, without notice. The changes will be effective from the date of publication on the Site. The continued use of the Site after the publication of the changes constitutes acceptance of the same.

2. Description of Services

The Site currently offers the following services:

2.1 “Work with Us” section

The Site provides Users with a section dedicated to opportunities for collaboration and work with Delicius. Through this section, the User can view current job openings and submit a speculative application or respond to specific job advertisements.

Sending the application involves providing personal data that will be processed by Delicius in compliance with current legislation on the protection of personal data (EU Regulation 2016/679 – GDPR). Please refer to the privacy policy available on the Site for all details regarding the processing of data.

Delicius does not guarantee that the submission of an application will lead to the establishment of an employment relationship. Receipt of the application does not constitute an offer or promise of employment.

2.2 “Longevity Nutrition Program” project

The Site allows Users to download a nutritional plan (hereinafter “Nutritional Plan”) after completing a questionnaire consisting of several questions concerning general information and related to their health condition.

The User expressly acknowledges and accepts that:

  • The Nutritional Plan has been prepared by a specialised third party (INRC – National Institute for Cardiovascular Research), which is independent of and separate from Delicius, and which assumes full responsibility for its preparation and content;
  • Delicius acts solely as a partner of the programme and provides materials; it has not participated in any way in the drafting, verification or scientific validation of the Nutritional Plan;
  • The Nutritional Plan is intended solely for general informational and educational proposes. It does not constitute, in any circumstances, a medical service, a diagnosis, a therapeutic or nutritional prescription, or personalised medical or scientific advice;
  • The information contained in the Nutritional Plan does not in any way replace consultation with a doctor, nutritionist, dietitian or any other qualified healthcare professional;
  • Delicius expressly disclaims any liability for any direct or indirect damages arising from the use or interpretation of the Nutritional Plan by the User or third parties;
  • Before making any changes to his/her diet or lifestyle, the User is strongly encouraged to consult a qualified healthcare professional.

The User declares, under their own responsibility, that they provide truthful, accurate and up-to-date information in the questionnaire. Delicius is not responsible for any inaccuracies or omissions in the answers provided by the User.

2.3 Contact section

The Site provides Users with a section dedicated to contacts, through which it is possible to send requests for information or reports/complaints to Delicius.

Sending messages via the contact form involves the processing of personal data provided by the User solely for purposes related to handling the request, in compliance with current legislation on the protection of personal data. Please refer to the privacy policy published on the Site for further details.

Delicius undertakes to respond to the requests received within the time reasonably necessary, without, however, guaranteeing a specific response time. Sending messages via the contacts section does not constitute the formation of a contract nor the assumption of any obligation by Delicius.

3. Obligations and Responsibilities of the User

The User undertakes to use the Site and the services offered in a lawful and proper manner, in accordance with these Terms, the applicable legislation, and the principles of good faith.

It is expressly forbidden for the User to:

  • Use the Site for unlawful or fraudulent purposes or for purposes contrary to public order and public morality;
  • Transmit content that is harmful, defamatory, obscene, threatening or in violation of the rights of third parties;
  • Attempt to gain unauthorised access to computer systems, networks or data;
  • Upload or spread computer viruses or any other malicious code;
  • Collect or process personal data of other Users without their consent.

The User is solely responsible for their use of the Site and the content acquired through it. Delicius reserves the right to report to the competent authorities any conduct that may constitute an offence

4. Intellectual Property

All the content on the Site – including, but not limited to, texts, images, graphics, logos, videos, software, databases and information materials – are the property of Delicius or of third parties who have granted a licence to use them to Delicius, and are protected by Italian and European legislation on copyright, trademarks and intellectual property.

Any reproduction, distribution, modification, communication to the public or commercial use of the contents of the Site is prohibited without the prior written consent of Delicius. Personal and non-commercial use is permitted, provided that intellectual property notices are not removed.

5. Disclaimer and Limitation of Liability

The Site and the services offered therein are provided “as is”, without warranties of any kind, whether express or implied. Delicius does not guarantee that the Site will always be available, error-free or uninterrupted.

To the extent permitted by applicable law, Delicius disclaims all liability for:

  • Direct, indirect, incidental, special or consequential damages arising from the use of, or inability to use, the Site;
  • Any errors, omissions or inaccuracies in the content published on the Site;
  • Contents of third-party websites accessed via any links on the Site;
  • Interruptions, malfunctions or temporary unavailability of the Site due to technical issues, maintenance or force majeure events.

In particular, and without limiting the foregoing, Delicius assumes no liability whatsoever in relation to the Nutritional Plan, as further specified in Article 2.2 of these Terms. Use of the Nutritional Plan is at the User’s full and exclusive responsibility.

6. Links to Third Party Websites

The Site may contain hyperlinks (links) to third party websites. Such links are provided solely for the User’s convenience. Delicius has no control over the contents of such sites and assumes no responsibility for their accuracy, lawfulness or completeness. The presence of a link does not imply any form of approval or endorsement by Delicius towards the linked site.

7. Personal Data Protection

The processing of Users’ personal data is governed by the Delicius Privacy Policy, drawn up in accordance with EU Regulation 2016/679 (GDPR) and current national legislation, available in the relevant section of the Site.

Use of the Site and the services offered entails the provision of personal data. The User is invited to read the Privacy Policy before proceeding with the use of the services.

8. Governing Law and Jurisdiction

These Terms are governed by Italian law. For any dispute relating to the interpretation, execution or validity of these Terms, the parties acknowledge the exclusive jurisdiction of the Court of Parma, unless otherwise required by mandatory consumer protection law.

9. Final Provisions

If any provision of these Terms is found to be invalid, void or unenforceable, the remaining provisions shall remain fully valid and enforceable.

Any failure or delay on the part of Delicius to enforce any provision of these Terms shall not constitute a waiver of the right to enforce it in the future.
